Welcome to SUPgpt, an application developed by Nixes (“Nixes”, “we”, “us”, or “our”) for Mac, iPhone, and iPad. These Terms of Service (“Terms”) govern your use of SUPgpt (the “App”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Acceptance of Terms

By accessing and using the App, you agree to these Terms and our Privacy Policy, which is incorporated herein by reference. If you are using the App on behalf of an entity, you represent and warrant that you have the authority to bind that entity to these Terms.

License and Platforms

Subject to these Terms, Nixes grants you a non-transferable, non-exclusive, revocable license to use the App on your devices for your personal or business use.

For macOS: You may use the App on up to 3 Mac machines. This license is not restricted to use by a single person.
For iPhone and iPad: The App must be downloaded from the App Store and is subject to Apple’s standard licensing terms.\

This license provides free updates.

Payment

For Mac: Payments are processed by Paddle.
For iPhone and iPad: Payments are processed by Apple through the App Store.\

By providing your payment information, you authorize us and the respective payment processor to process your payment.

You can request a refund within 30 days from your purchase for any reason.

Restrictions

You agree not to use the App for any unlawful or malicious activities, or in any way that may harm us or third parties. You may not distribute, sell, lease, rent, lend, or sublicense the App to anyone else.

AI Services and Third-Party Services

The App utilizes various AI services, including but not limited to OpenAI, Claude, Google, and Groq. By using the App, you agree to abide by the terms of service of these AI providers. We are not responsible for the content, functionality, or availability of any third-party service, including these AI services. You acknowledge that the use of these AI services may be subject to additional terms and conditions set by their respective providers.

Content Ownership

We do not claim ownership over the content you create using the App. However, by using the App, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, and display the content within the App and in connection with our business.

Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

IN NO EVENT SHALL NIXES, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

Indemnification

You agree to indemnify and hold harmless Nixes and its officers, directors, employees, and agents from any claims, damages, expenses, including attorney’s fees, arising from or related to your use of the App or violation of these Terms.

Governing Law

These Terms shall be governed by the laws of Bulgaria in which Nixes is registered, without regard to its conflict of law provisions.

Modifications to Terms

We reserve the right to modify these Terms at any time. Your continued use of the App following any such modification constitutes your agreement to the new Terms.

Refund Policy


30-Day Refund Policy

We believe in the quality of SUPgpt, but understand that it may not be the right fit for everyone. That’s why we offer a 30-day money-back guarantee from the date of your purchase.

To request a refund, please adhere to the following process:

For Mac purchases:
Direct your refund request to our support team at hi@supgpt.app with “Refund Request” as the subject line.
Include your order number and the email address used for the purchase.
Though not compulsory, we appreciate any feedback regarding your reason for the refund to help us enhance our app.\

For iPhone and iPad purchases:
Please contact Apple directly to request a refund. You can find more information on how to do this at https://support.apple.com/en-us/118223

Exclusions

Important: Our Mac refund policy does not apply to purchases made during promotions, sales, or through third-party campaigns. Please be mindful of this exclusion when engaging in such offers. For Mac purchases, refunds are not applicable for transactions made outside our official website or Paddle’s payment processing.

Processing Refunds

For Mac purchases:
Once we receive your request, our team will review it and notify you of the status within 3-5 business days. If approved, refunds are processed back to your original payment method within 5-10 business days, depending on your bank or credit card issuer’s specific policies.

For iPhone and iPad purchases:
Refund processing times and policies are determined by Apple. Please refer to their refund policy for more information.
